Even if you submitted I-485 for your child before Oct. 1, 2005, but to my knowledge, if at the date your I-140 get approved but no visa number is available due to "排期”, then your PD will be not current at the date your I-140 get approved. In this case, your child’s age may be not be able to be “frozen” at your PD date. About this issue, you’d better to consult with more lawyers.

Anyway, re-submitting I-140 is necessary. May be you still have chance to “Freeze” the age of your child as the age of “child”. Go ahead to consult with more lawyers!
