NIW EB2 without ETA750B

Please comment NIW EB2 without ETA750B

Send NIW EB2 before the end of September. Still no receipt. Yesterday my lawyer sent me the following message:

The USCIS this week announced that form ETA750B should be submitted with NIW filings. They had previously stated that this form, which is the old labor certification form, should no longer be used since PERM replaced this form. To be safe, I recommend that you complete the form which you can find at the following web site, print out two copies, sign them and give them to me. I will mail them in to the USCIS to be placed with your I-140 petition.

What could happen to the I-140 petition? Will it be rejected, denied? Or, will I get a RFE? Now I lost confidence in my layer, as this publication clearly states ETA750B is required for NIW:
