First, double check the dates you put in 9089 met the requirements. they handled it by computer so one day off will result denial. like the newspaper ads, job order, two of the 3 optional recruiments must end >30 days
1. it is generally believed refiling is better than appeal to BOLCA
2. dol should send you a letter explaining the reason of denial. wait on this before refiling so you know what was wrong with the first filing
3. check you dates. ending dates of job order, newpaper and other recruitment ads, and the "notice of filing" posting must be no more than 180 days before you file a second time. if you have filed the first one right after 30 days, you should have enough time to file it again w/o redo all these steps.
4. prevailing wage. this has an expiration date. make sure you file the second time before exp. if necessary submit PWR second time. it is free and for some states it takes only a day or two get PW. for some states e.g. CA it may take a month to get PW. so plan your date again.
5. make darn sure you file the second time 365 days before the 6 yr end of your h1, or you have to figure out other ways to legally stay/work in US.
If you provide some key info in 9089 you filed (like the SOC/O*net code in F section, answers to questions H-4, H-5, H-6, H-12, H-16, J-11, J-12)
