If so, don't worry. One of my friends once had situation like yours. After his application for H-1 was submitted, INS called the international office that my friend's status had been out of status when they receieved his packet. The officer at the internation office told the INS it was their fault or not my friend's. But you still have to get your application submitted ASAP.
