leaving without AP dismiss 485

So, the minute you leave US without AP, your 485 is dismissed automatically. However, your H1 is stil valid, and you can apply your H1 visa in BJ with little problem. But you need to resubmit 485 after you come back to US, which may not be easy because the visa number is not current for now.

So for your 485, you HAVE to apply AP before you leave US. Your H1 status will not be affected, as far as you come back to the same employer.
