He is definately EB-1 (EA), have you heard any EB-1 485 pending from year 2002, the year he got drafted?

The rules are made here by US people, are you trying to challenge them by a specific example? That's the last thing they want to hear from you. Yours are yours, his is his, why? That's the way it is. There is always some special handlings, the question is do YOU qualify for it, and do THEY grant to you.
