As long as USCIS does not announce stop receiving H1B, you can submit.
H1 numbers do not use backlog system, if the quota is all gone, USCIS will dismiss the line and you will need to re-apply again next April. For those adopting backlog, your case will stay in the pipeline for next years' quota.
