Two of my friends used AP to go back to China. And both of them have EAD just didn't use it to work. Both of them have H1-B renewed after they came back from China using AP.
Maybe this is against law but seems like everybody is doing it. So should be no problem at all. And you don't need to tell your employer that you will go back to China. Just a vacation.
