The original H1B approval notice is most important. Whether he actually has visa or not, is irrelevant to your H4 visa application.

Don't worry too much. As long as you have all documents in order, you should get H4 visa and come back without any problem since H1B/H4 is allowed to have immigration intention. F1/F2 and B1/B2 are more problematic.
