Removes Annual Cap on Persons Granted Asylum Seeking Green Cards
In contrast to the strict new provisions for asylum applicants, the Act liberalizes the adjustment of status to permanent resident for persons who have already been granted asylum by removing the annual cap for such persons in applying for green cards. Before the law was signed, no more than 10,000 persons a year could adjust to permanent residence status on the basis of having been granted asylum. This cap created a backlog of over 150,000 adjustment applications, and a waiting period of more than five years. The new law should eliminate this backlog and make most of these pending applications eligible for immediate adjudication.
