H1 transfer confused

我想知道我現在是H4,今年8月1日辭職的,換為H4身份.現在又找了一分工作,公司要我9月19日上班,現在的H1申請還在律師手裏,他說隻要受到RECEIPT就可以上班了. 他說的對嗎? 因為他是公司裏的律師,不是專門的移民律師,我有點不放心.因為記得以前那位大俠講過, 需要等到H1 APPROVAL 才可以. 我這算不算H1 transfer ? since there is one month gap inbetween two H1 ?
