Just received the email from my attorney that my H1B petition package was returned from Vermont Service Center and was instructed to resubmit to Texas Service Center. I am currently working for a university with H1B, which is not under the H1B numerical cap. I recently got an offer from a company, so this new H1B petition is subject to H1B cap. In order to work right away, I can only apply for the 20,000 supplemental H1B of 2005. So I don't think there is anything wrong with submitting to Vermont service center. I guess VSC thought I could just simply transfer my H1B from my current employee to the future one. My attorney told me that it was not unusual for the government to make these kind of errors and suggested to resubmit all the documents to VSC immediately. Anyone has similar experience? Any suggestions for dealing this kind of situation will be highly appreciated. Thank you!
