My understanding is that if you have an expired H-1 stamp, you can come back within 30 days without a valid H-1 stamp. If you originally entered US as a F-1 student and transfered to H1 and never has a valid H-1 stamp, then you need a valid H-1 stamp to come back.

Please correct me if I am wrong.
