You should have submitted in duplicate with the original package!

Read those instruction more carefully.

Since NIW belongs to EB2, it should require the labor department approval. Since NIW waive the LC, you don't need to deal with labor dept, but the form ETA750B should still be filed. One copy for CIS (don't call them INS any more), one for labor dept.
