Can I go gack?

I entered U.S as B1 in 1998, and transferred it to F1. In April 2004, I had my first H1, but it was effecitive in OCT. the same year. My parents was rejected for four times by the visa officer in Shanghai, and I really want to go back and visit them. Do I still qulified to apply for "H1 Fan Qian", so I could apply for the re-enter H1 visa before leave U.S. What should I do to apply for it?
