Currently, I am H1B, my wife H4. My Eb1-b I-140 was approved, while I-485 is pending. We both get our AP.
Questions:
1. If use AP come back, will my wife be I-485 pending only?
2. Is it better to apply H4 visa for her while we are in China?
3. If H4 visa denied, could she still use AP to come back?
Last but least:
Are there any other supportive documentations I need to bring with my AP to come back rather than following list?
1. AP
2. My I-797 for I-140 approval
3. My I-797 for H1B
4. My wife's I-797 for H4
5. Our I-485 receipts
5. Pay stubs
6. ID (work, driver license)
7. Letter of employment (from manager, signed on a letterhead)
BTW, I heard from one of friend, I have to bring 3 copies of AP together. One for my record, one to surrender at the airport, and one for them to mail back to USCIS. Is it correct?
Could we go through the line for GC/Citizen?
Are we going to take photo/FP?
