可能是我孤陋寡聞，沒聽說過這一條。

The whole purposes of maintaining Non-immigrant status during 140/485 pending is preparing for possible 140/485 denial(then you will not out of status). Since using AP dose not affect H1 holder's non-immigrant status, why should he get into trouble when his 140/485 is denied. I can not see the logic here
