在美國大多數州(我在紐約州,也許有少數州不同),你買一個house,你得到產權證,你擁有title, 擁有land and the permanant structure。看看我買一處房子時律師的解釋如下, 英文應該叫“絕對產權”。當然還有什麽“fee simple defeasible”, "fee simple determinable"等等之類的,和我們個人關係不大就不說了。當你擁有產權你無限期,無條件繼承下去。這時候你必須交real estate tax.
When you own real estate outright, holding and controlling the entire bundle of sticks, we call it owning it in “fee simple absolute.” That is, as the title holder you, as the individual have the full absolute possessory right to the property, now and in the future, for an infinite duration, with no limitations on its inheritability (right to be transferred to others through death). The holder of the real estate owns entire estate (or bundle of sticks), and has the absolute and unfettered legal right to dispose of it without permission or consent by anyone else.
不知道別的國家,美國的房產項目分的非常細,相關法律也非常細,我不是這方麵的專家,隻是略知一二。比如還有一種房產交leased land housing. 就是你買這個房子但你不擁有下麵的土地,一個例子就是美國有種房子叫co-op。co-op的房子你不擁有deed or title(得到的是stock certificate means you can use the house and the common area), 不交real estate tax,交的是管理費maintenance fee,所以這種房子就便宜得多,但是管理使用費用就會高,因為land owner(私人或私人公司)會把他要交的real estate tax分攤到管理使用費中。這種房子的不好的地方就是有租期,你不是無限期擁有這個房子,到期就得搬走,當然要看具體contract怎麽寫。
我認為中國的房子類似這種leased land,但是要比美國的自由度大一些(比如可以自由裝修,可以繼承),但也是有年限的。黨和政府擁有land 和對房子的絕對產權fee simple absolute,所以征收的應該是管理使用費而不是產權稅 real estate tax。
