類似這樣的協議書有用嗎？

孩子在澳大利亞購房，急需國內父母救助，大約要父母出一半的錢。其父母隻有賣掉自己的房子籌錢。父母與兒媳關係不好，
特別擔心兒子可能今後被甩。所以想簽類似這樣的協議：

1. 父母借錢xxxx給兒子家，兒子應該在其與xxx婚姻沒有終止之前還款，另加年息xx.
2. 若兒子婚姻終止，應在其家產分離之前退還此款。


這樣的協議有用嗎，需要兒子夫妻都簽嗎？
