CC&Rs vs HOA

HOA, 說白了,就是個婆婆媽媽的街道居委會。


There is no way for home buyer/owner to better understand HOA w/out careful reading its CC&Rs.



HOA也有共產的意思。 5樓張三家的屋頂要修,憑什麽要漲我一樓的李四的HOA by 1 萬多刀?

有的HOA包水,大戶人家拚命地浪費水,小戶人家沒見HOA少個子兒。 

還有,讀CC&R,看有沒有出租限製,有的地方不讓出租,或者有waiting list, 更有甚者,租約隻能6-24個月,要批準,有限額,HOA還要interview租客。 出租率大於50%, 貸款有困難。 HOA通常限製出租率在40%以下。 出租率高,HOA一般也高。 SFH社區,租金高,出租率現對低些,換言之,自住率偏高,因此,HOA較Condo, TH為低,後者維修管理費較高, HOA自然水漲船高。


因此,買房時須注意:


- ask for CC&Rs, put it in your offer as contingency.  Don’t expect your agent to help w/ HOA disc.  On CA standard purchase agreement, mark B of clause 10:


- CC&Rs,  


- 1 yr HOA minutes, 3 yrs FS, a statement of reserves, assignment of parking spaces, etc.


- does HOA have adequate reserves?  In condo, the money in reserves must cover repairs to all common spaces – roof, garage and the like.  You are better off with a fee that’s too high, not too low…


- avoiding disputes w/ HOA b/c any lawsuit will result in a decrease in property value.


 擺平HOA的最有效措施就是深入敵後,弄個街道居委會主任做做, 如果能力和精力允許的話。
