臨時綠卡兩年轉正

通過與美國公民的婚姻，來獲得的綠卡，多隻有兩年的有效期。而不是通常的十年。
蓋起原由，不外乎以減低欺詐的可能性。
除了公民配偶的綠卡是兩年期外，其跟隨的同時移民的子女的綠卡也是相同的有效期。
所以，在到期之前，臨時綠卡需要申請轉正。轉正所用的表格就是 I-751.
與綠卡結婚而獲得的綠卡，也有兩年臨時一說。但是由於這一類的排期通常都是在兩年之上，拿到綠卡時已經是在結婚兩年之後了，所以就徑直是十年期的綠卡。
臨時綠卡申請轉正，不是持有人一個人就可以辦的，必須和公民身份的配偶一起申請。另外，臨時綠卡身份的移民子女，如果是與家長同時申請的綠卡並且在其家長入境 90 天之內入境，就能在其家長的轉正申請中一筆帶過。否則，該子女需要單獨申請來進行轉正。
上麵提到的轉正申請，需要和公民一起申請。如果公民不簽字，是不是就不能申請了？
移民局說，單獨申請也行，但是得滿足下麵的條件之一：
１）公民已經往生；
２）婚姻終止；
３）臨時綠卡受虐待；
４）不轉正被逐將導致極大艱難。
什麽時候申請轉正？
如果是和公民一起申請，在臨時綠卡到期前 90 天中；如果是上麵單獨申請的情形，任何時候均可。
如果沒有及時申請轉正，會怎麽樣？臨時綠卡失效之後，其持有人就失去了身份，就能進入驅逐之列了。
但是，在臨時綠卡失效之後，仍可提交轉正申請。申請人需要附信解釋延誤之由。如果移民局認可你的延誤之由，並且延誤之期在合理範圍，則將你的身份失效一筆勾銷。
怎麽知道一筆勾銷了呢？你的遲交的I-751 申請被接受了，便是。

除了申請表格和費用，申請人還需要提交相對應的證明文件。
如果是夫妻共同申請，提交一切可以證明夫妻關係仍在維係的文件，這些文件沒有定製，多多善益。
申請文件清單：

• 綠卡正反麵複印（包括同時申請之孩子的）
• 上述證明文件（包括同時申請之孩子的）
申請的郵寄地址，分別為東西兩大中心之一。
投資移民(EB-5)的綠卡也是兩年期的，需要在失效前 90 天內申請 I-829 來轉正。其收據可將臨時綠卡延長六個月，或直至 I-829 處理完畢。
臨時綠卡何時轉正與將來的入籍毫無關聯。
另外，轉正不再需要麵試。

If the kids is old than 14 years old, the kids have to 單獨申請 for green card. I did apply the green card with my son, because the day I submit the documents was one day passed my son's 14 birthday, he did apply 單獨申請.
