EB2 PERM I140 approved。priority date是2016年6月。現在485排期已經到了。但是處於職業發展考慮已經接受了一個加拿大的offer. 我已經向我現在的工作單位提出辭職了。我不能申請485了吧？我現在的工作單位可以取消我的140嗎？

-No, but you cannot use it to file I-485 unless you come back to work for the employer. Also, if you cannot file I-485 within one year from the date your I-140 priority date is current, the I-140 will be invalid even if you come back to work for the same employer.

 

如果離開美國兩三年，再回來，如果有單位給申請綠卡，還可以用這個PD麽？-Yes.如果可以的話，我就沒有排期了吧？現在需要做什麽以便將來還可以用這個PD？-Keep the copy of your I-140 appoval notice.  如果兩三年後得到的職位和現在是同樣的，隻是高級和初級的區別。那時還需要辦理Perm嗎?-Your new employer must file a new PERM and I-140, but you can use the old priority date.

 

另外一個計劃：如果現在自己申請NIW為以後回來作準備。如果NIW批準的話，還可以用這個PD麽? -Yes.一定需要一個美國的雇主才能申請485嗎？-You had better have a job.
