謝謝8老師,我可能第一個問題沒說清楚,我是想問,公司說準備一個月後layoff了,如果我和公司商量,用non paid leave來拖時間,他們也不用pay我,而我如果能夠這樣保持住H1b身份,最少可以繼續找別的,要不不一定能在一個月之內找到下家
-The problem is that when you do the H1 transfer, you need to provide the recent 3 months paycheck stubs. If you do not get paid, you do not have the payscheck stubs and thus, USCIS may approve your H1 application, but the approval may have no I-94 and then, you just need to go to CHina to get the H1 visa to come back. That is no big deal, anyway.
如果是這種情況,也就是說希望h1b保持但又non paid (也許幾個月?不知道有沒有時間限製,總之希望拖到和找到的下家接上),不知道可行否?是不是要有合理的解釋,比如family reaso?
