For non-Canadians, who need a nonimmigrant visa, the waiver is applied through applying for a nonimmigrant visa. If the person is denied the visa solely due to the ban and not due to immigrant intent, and if the officer recommends a waiver, they will tell the person how to apply for a waiver. But if the person is denied due to immigrant intent, or if the officer doesn't recommend a waiver, then there is no way to apply for a waiver. See 9 FAM 305.4-3 for more details.
