謝謝，NIW pending 期間是否可以considered as legal status?

-It is irrelevant to your legal status. You have to have a non-immigrant status such as H-1, F-1, B2, or have a pending I-485 (you cannot file I-485 until your I-140 priority date is current, so this does not apply to you now, especially you even do not file I-140 yet). 

還是到期了就必須離境？

-If you do not have a legal non-immigrant status such as F-1, B2, you need to leave US as soon as possible.

一般NIW多久可以有結果？

-Hard to  say, case by case.
