請問8老師， 我是加拿大公民,TN簽證在美國工作， 今年剛抽到H1B. 今年5月底回加拿大。想在返回美國的時候由TN換H1B, 有沒有風險。

-No problem. But you cannot get the H-1 status until October 1, 2024, because the new H-1B of 2025  is effective on that date. Your employer needs to file I-129 to USCIS for th H-1B application and then, you can use the H-1B approval Notice to come back to US to get the -1B status after October 1. If you come back to US before October 1, you only can use TN status.
