我朋友兩口子自己申請的NIW是2009年7月份批準的，男方持H1B簽證，女方持H4簽證。他們的兒子在美國出生後2011年全家回國，NIW既沒撤銷也沒有再推進。2023年12月朋友的老婆以旅遊簽證帶孩子來美讀初中。老公繼續在國內工作。他們兩口子想請教8老師如何解決他們的身份問題。

-She may file I-539 to extend her B2 status after  to 5 months later from the date she entered US. But it is very difficult for his wife to maintain her B2 status after her first extention (if approved). 

他們的case是否仍然有效？

-Yes.

如果有效是否可以自己直接提交（還是請律師）485？

-He needs to enter US to file I-485 and her wife also can file I-485 together with him.  Her wife cannot file I-485 separately if he does not file I-485 within US.

Another choice is that he files I-824 to request USCIS to forward his approved I-140 to NVC for processing for him to apply for the immigrant visa in China, and then his wife can go to China to apply for the immigrant visa together with him.

應該注意什麽問題？老公目前在國內的工作和之前在美的工作勉強有關。

如果他們的case失效，應該怎麽辦？

是否可以拋開之前的case請律師重新開始申請EB1A？
