請教八老師，EB2 I-140 已經獲批。現要轉EB3。從priority date開始算，公司2020年虧損，我的工資達不到最低工資要求。2021，2022年盈利，同時現在我的工資已經超過要求的最低工資。EB3 的I-140如何辦？律師說需要寫一封說明信來解釋原因。

-USCIS recently changed the rule which is more favorable to the employer and the beneficiary. Based on the new rule,  USCIS do not require that the employer has to demonstrate the ability to pay from the date the employer files PERM until the beneficiary files I-485, but the employer only needs to demonstate the ability to pay when the beneficiary files I-485. So, I think the explanation should be OK.

如果解釋不被接受，會不會影響已經批準的EB2 的I-40？
