請問8老師，等待485的過程中，準備用回美證回國，當時沒有申請EAD，目前還是在用R1工作。當時覺得沒有必要申請EAD，所以沒有申請。現在想申請有個問題。過幾天就要回國了，回國回來身份就會變成Parole，回來以後再申請是不是好一些。看了一下765的申請，有一些可以加快，有一些不可以加快。如果現在申請，應該不能加快；如果回來再申請是可以加快的，因為那時候是Parole，對不對？

-Not really. You had better file I-765 as soon as possible. It takes a long time for EAD to be approved. Even if you request expedite processing for the EAD, USCIS may not approve your request for expedite processing.

By the way, your EAD application is based on your pending I-485, so the EAD category should be "(c) (9)", not "(c) (11)".

"(c) (11)" is for an alien paroled into the United States in the public interest or temporarily for emergency reasons, so it is not your case (i.e., you are in a different type of parolee status after you enter US using advance parole)..

So, you must fill "(c) (9)" as the category in I-765 and provide the copy of your I-485 Receipt Notice.
