I am filing for H4 along with my husband's H1 petition now. On form I539, I am not so sure about one question.

 

Is this application based on a separate petition or application to give your spouse, child or parent an extension or change of status? 

 

The first choice is "Yes, filed with this I539" 

The second choice is "NO"

 

Should I check the first one or the second one? I prefer the first one,

-You are right, say "Yes". If say "No", then you have to provide the copy of the H-1 approval notice.

 

but somehow the lawyer checked "NO"
