I have a similar situation in question3 途徑一:

your child may renew his/her B-2 status again and again. how easily can the child's B-2 status be renewed and how many times can the child's B-2 status be renewed? is there any limted time?

我的情況是這樣的：我已綠卡（EB2, NIW）；愛人和小孩在國內。我和愛人結婚是在我獲得綠卡之前，而小孩出生於我獲得綠卡之後。

 

時間先後順序：結婚-我綠卡-小孩出生。

 

 

 

想請教的問題：

 

1. 小孩出生日期在我獲得綠卡之後，所以小孩不能辦理 follow-to-join 獲得綠卡? 對嗎？

-Right.

 

 

2.小孩能否辦理B2簽證每年來美探親？

-Yes.

 

新的簽證政策B2探親簽證10年有效，所以理論或實際上小孩可以10年內多次往返美國？

-Yes, but your child may renew his/her B-2 status again and again until your I-130 priority date (PD) is current to file I-485 due to his/her age is too young.

 

 

3. 小孩辦理綠卡的可能途徑。

 

途徑一：申請B2入境，然後境內提交I-130表。不知道小孩是否能在境內合法地等待綠卡申請的處理，不受原來 B-2 停留期的限製？

-Need to renew B-2 status (see above answer). 

 

 

途徑二：提交I-130表，小孩在廣州獲得移民簽證來美（F2A類別）。請問前後大概需要多長時間？

-This is another choice. Your child can go back to China to get the immigration visa when the I-130 PD is current. His/her illegal stay in US (if any) will not affect his/her immigration visa application in China because his/her age is less than 18 years.

 

步驟複雜嗎？

-No.

 

能否自己DIY,還是必須請律師辦理？

-Up to you.
