If he never apply a waiver,it's mistake of VO,if the

US customs officer find out when he try to enter USA,he
may get refusal entry ,even deportation.
If he reported the situation ( out of state for 3 years )when he applied visa ,but still get a visa,usually mean he already got a waiver. As my understand, applicant should apply waiver to CIS first,but not DOS (embassy/consulate)
