我是從加拿大過來的，一直在同一個公司工作，EB2 I-140。從排期看，不久就能File 485了, 但是我的兒子還在加拿大上大學。

請教老師：

1. 在File 485的時候，是否我的太太和兒子都必須在美國？-Yes. They need to be physically present in US to file I-485. 他們必須持有H4簽證嗎？-They need to have a legal status such as H-4.

2. 在File 485後 (485 pending期)，我的兒子能否回加拿大繼續上學？-He can apply for advance parole (AP) and get it approved to travel. AP allows he to stay outside US for less than one year. He can come back to US to renew AP, but he must get the approved AP before he leaves.
