今天剛剛收到Legal通知，H1B批準了（non-cap, PP）。當時遞交材料的時候，是連同孩子的H4一起遞交的，請問USCIS是會另外生成一個H4的case number、另外再寄Receipt嗎？

-Yes. To change the J-2 to H-4, your kid needed to file I-539 together with your H-1 application. This will have a separate receipt notice from your H-1 application (your H-1 was filed by your employer and H-4 should be filed by your kid). Did you hire a lawyer to do it for you? Make sure your kid filed I-539.

現在沒有收到關於H4的任何信息，是不是他們根本還沒開始啟動？還是說，H1B批準的時候，同時孩子的H4就批準了？孩子的J2到7月也就過期了（因為J1到7月結束，已經waive）。如果到那個時候H4還沒批準，是不是孩子就沒有合法身份在美國了？

-If your kid has filed I-539 to change the J-1 to H-4, then he/she can legally stay in US to wait for the H-4 approval. If he/she has not filed I-539 yet, then he/she needs to leave US now because his/her J-2 was invalid from the day your H-1 was approved.
