網上搜了一下好像沒我這樣的case… 基本情況是：

485 3/21交的，現在pending (Eb1)

OPT 6/24到期，從老學校辭職。沒有申請OPT延期，因為已經交485了

新學校給我申請的H1b non-cap 已批準 （H1b申請的I-129表上填了485的收據號並附上了485收據），批準件上有新的I-94。生效日期 8/15

 

我的問題是：6/25-8/14，我OPT結束，屬於已經out of status，雖然是legal presence (60 days grace period)

我這種情況可以8/15境內自動身份轉換成H1b嗎？
-Yes, your status has been changed to H-1B which will be effective on August 15. So, you can continue to stay in US (legal stay during the F-1 grace period even if you do not have pending I-485) and begin to work with H-1b status on Aug. 15.

學校律師說一般需要有 “有效的status”才能自動境內Change of Status，
-You can change your status to H-1 during the F-1 grace period (not have to have a status in your case), and that is why USCIS approved your H-1b with the I-94.

但移民局的I-797批複件上又給了新的I-94，說明應該也能境內自動轉。_Correct.

是不是跟我已經交485有關呀？OPT和H1b之間有Gap還能境內自動轉身份嗎？-You cannot work during the F-1 grace period.  If you got the cap H-1b, then you could work in the period of the OPT and H-1B gap. This is the difference between the cap H1B and non- cap H-1B.. So, you have to wait until August 15 to work.


到底需不需要出境簽h1b呀-Not need in your case.
