7月28日被裁，當天 termination date， 工作Offer 明天一早到，學習了8老師對於其他朋友問題的回答，我的理解是30日之內file H1-B transfer 應該問題不大，我明天開始和律師做Transfer，估計28日file 上去有點懸，要看HR 和律師的速度，律所的主管律師明天還不在。律師說有可能要回中國簽證（現在還不是特別理解為什麽要回中國簽證，去加拿大或墨西哥簽不是近很多嗎？）

-Because you are out of status from the date you were laid off, you have to go to the home country (China) to get the visa if the H-1 approval does not have I-94.

看到8老師解答前麵的問題時好像提到 可以 Premium Processing，不知道Premium Processing 對於降低回國簽證的概率的作用大不大。

-Premium processing or not does not affect the final result, but only to get the result fast. 

我現在最關心的是寶寶太小，飛回國對寶寶的是身體太折騰，不太好。如果不Premium Processing, 這個case 最終移民局處理下來可能要幾個月的時間，到時候如果需要回國簽證，寶寶已經稍微長大一點了，五個月小孩的小孩長途飛行要比兩三個月 的小孩承受能力要稍微好點吧。 如果 Premium Processing,  很快就知道結果，如果需要回國簽證的話很快就要動身，寶寶還太小，不知道不 Premium Processing 會不會為寶寶多爭取一點長途飛行之前的成長時間。當然如果Premium Processing 可以減少被要求回國簽證的概率的話我還是很願意考慮的。

-Then, you don't need to use the premium proicessing. You can work for the emplolyer after the H-1 transfer petitioon is filed. If the H-1 petition approval has no I-94 a few months later, then you can go to China to get the H-1 visa to come back. But as I always say, filing H-1 transfer in about 30 days probably will get the full approval (i.e. the approval has I-94), so youy may not need to go to China to get the H-1 visa in your case.
