今年的H1B已批，如果下月交485的話，對已批的H1B有什麽影響？
-Not affect it.

我的理解是如果不用485的EAD的話，10月1日以後還是H1B？
-Yes.

如果拿著AP在H1B生效前回了趟國，那又是什麽身份？
-If you come back before Oct. 1, your status is parolee, and will be H-1 after Oct. 1. If you come back after Oct. 1, then your status will be parolee, but you can use the H-1 benefits such as work without EAD, and can do H-1 extension/transfer to reinstate your H-1 any time.


然後一個更棘手的問題。

主申請人還是F1，剛畢業, 剛申了post completion OPT還沒有批，要求的OPT開始日期是7月。現在NIW排到了，但是還沒有工作offer，這種情況怎麽交485？
-How did you get the H-1 approval if you did not have a job offer? Just file I-485 and then, try to find a job as soon as possible if you don't have a job.

想到的方法是找博士老板開volunteer的證明（按照政策，目前到7月OPT生效前不可以工作）。
-You have 3 months to look for a job from the date when the OPT is approval. So, you still have a lot of time to find a job because your OPT is not approved yet.

那這個證明是不是要寫從7月份開始？
-No, within 90 days from the OPT approval date.

還有其他的解決方案嗎？
