我們一家綠卡身份多年了，1年前從中國領養了一個孩子。孩子以 b2 簽證入境後，馬上申請了 家屬綠卡。但是已經等了這麽長時間也沒有什麽動靜。b2 已經延期過一次沒有rfe，再次延期的時候來了rfe。不知道該如何是好。
-Just respond to the RFE. If the B2 extension application is denied, one of you (father or mother) has to get the US citizenship and upgrade the I_130 from F2A to the Immediate Relatives of US citizens, thus the child can get the green card within US. Otherwise, the child has to go to China to apply for the immigrant visa.

By the way, if the child is less than 18 years old, his/her unlawful presence will not be subjected to 3- or 10-year bar; and that means he/she has no problem to get the immigrant visa in China. Of course he/she also has no problem to get the green card within US if you are a US citizen.
