謝謝老師的回複, 我是LZ, 我的EB2和EB3的140上PD是一樣的, 但是我上次提交485 application based on EB3, 材料中包括EB2的I140 approval notice(I797)和EB3 蓋了approval章的I140 form(FOIA要來的), 遭到USCIS退件,reject的理由是PD沒有current, 那麽這次看到老師的回複, 我理解是材料中包括EB3 的I140 form就可以了

, 再有一個問題, 我再次提交時, 是隻把cover letter換一下, 把EB2 I140 approval拿走, 剩下的原封不動提交呢, 還是重新打印一份485 form, 重新寫一張支票等 (也就是重新準備一份申請材料)呢? 因為我看見原來的材料上每頁的底部均蓋有時間戳, 並且還被劃掉了寫上類似於reject的字樣, 支票上也打上了USCIS的名戳, 這樣原封不動交上去可以嗎?
-Fine to send the old packet back. Enclosed the USCIS rejection letter (put it on the top). Make sure you put the correct EB-3 I-140 case# (i.e. receipt#) in the I-485.
再cover letter上, 是否需要寫上上次被reject是不對的, 請求tier 2 officer review?
-Don't mention it and just treat it as you file a new I-485. Make sure the PD is current in February or March (DOS announcement of cuff-off date in February is for March). .
