很感謝。Do I need to follow EB3 catagory to submit I-485 or EB2 catagory (Since EB3 waiting time is 3+ years more than EB2)?
In another word, my proved EB2 PD is 03/2008 which is expected to be current in 2012. Can I submit my I-485 with newly proved EB3 next year?
-No. You have to wait for your EB3 PD is current which begins on the date of your EB2 priority date. You had better ask another laywer whether you can file EB2 again under your current employer' sponsor because it seems the position is EB2 position (I do not agree with your current lawyer).
