我老公申請EB2 收到移民局的RFE。我老公不太明白怎樣的條件才符合這個212e：在本國或居住地居住夠兩年的要求。
我老公是孟加拉人，他2000年來美國的時候是J2， 我公公是J1，他作為家屬隨行 。然後2001年我老公去了墨西哥申請了學生簽證F1，來美國讀本科，暑假都有回孟加拉。2003年我老公本科畢業，然後拿resident permit去巴林工居住。（那個時候我公公在巴林工作居住，全家人都拿的是巴林的resident permit) 2005年我老公又來美國讀碩士和博士，偶爾暑假回家。然後2012年拿到H1B。2014年10月，I140獲批，同月提交了I485。2016年1月26日收到到RFE，要求證明符合這個212e：在本國或居住地居住兩年的時間。
他在孟加拉呆的時間主要是暑假，零零碎碎加起來有一年多，在巴林呆的時間是整個的，有一年半左右，加起來超過兩年。但是巴林這個一年半算不算，他一直沒有辦法找到答案。
-He has to stay in 孟加拉 for two years. His stay in 巴林 is not counted as the two-year home country residency. One solution is that he may apply for J-2 waiver by himself independently because he is > 21 years old. But it takes time to get the J-2 waiver, so he has to ahve a legal status (e.g. H-1B) to stay and work in US. His I-485 will be denied very soon because he can not provide what the RFE asked at this time. After he gets J-2 waiver. he can file I-485 again.
