請問8老師
本人EB1A 綠卡批準後，LD遞交485 以follow up 的形式申請她的綠卡。上周收到移民局回信， 要補充材料。
一共兩封信。 名稱都是（Request for evidence）分別是12 和16號寄出。 內容不相同。 12號的信說 1）confirmation of a job offer or request to port 和 2）需要更過期的From 693。 但是16號的卻說要補充1）birth certificate 2）需要更新過期From 693。
我們的困惑
- 兩封信以哪一封為準？ 是時間上最後的一封嗎？
- 還是兩份信都要回答？
- 針對12號的信第一條1）confirmation of a job offer or request to port。具體內容如下“You must submit a properly completed and signed supplement J, confirmation of Bona Fide Job Offer or Request for Job portability under INA section 204 (j), showing that the offer of intended to port to a new offer of employment in the same or similar occupational classification as the job specified in the underlying From I-140. You may be eligible to adjust pursuant to section 204(j) of the immigration and Nationality Act (INA) if
. Your Form I-485 application has been pending for 180 days or more, AND
. Your new intended permanent employ employment is in the same or similar occupational classification as the original Form I-140
- LD是follow up 我的EB1A， 根據我的理解她是不需要有雇主的永久職位的工作證明的。我們如何給移民局解釋這一點呢？(是不是移民局搞錯這個案子的分類了？
- -Your understanding is correct. Your spouse may just write a letter to explain that her I-485 application for adjustment of status was based on your permanent residency as your derivative. So, she does not have to have a job. Also provide the copy of your marriage certificate and the copy of your green card again with the response letter though you have submitted these documents when she filed I-485.
- 關於出生證明， 以前的小地方沒有正式的原始出生證明文件， 都是手寫的(我們提交的手寫的未提及父母名字之類)-This does not need the USCIS requirements. The birth certificate needs to include: parents' names, place of birth, date of birth. You may ask the local Police Department in China to issue a certificate, and then go to the Department of Notarization in China to do the notarization which including the translation version.
- 。 針對這種要求，父母關係公證書是否有效？-No. If you have this, also provide it (it is helpful, but birth certificate must be submitted).
