我的EB1 485已獲批，我配偶4月初以B2 visa來美，本打算7月給配偶申請485身份調整。但由於今年EB1從6月開始出現了排期，預期10月份才會回到current狀態，所以我打算給配偶10月份申請。問題是我配偶的B2 VISA 10月2號就到期了，論壇裏有人因郵寄延誤導致錯過時機的案例，所以我想提前幾天寄出申請材料。請問：
1. 申請10月份的485身份調整，申請材料9月底寄達USCIS的話，會否因時間不對而被據？
-It is not good. The application materials must be received by USCIS on Oct. 1 to October 31. You may sent it out on Sept. 30 using overnight express mail.
2. 踩在B2 VISA到期的時間點上提交材料會不會有問題？
-No problem, especially there is 245(k) benefits for your wife's case (employment-based category), so it is fine even if a few days late for the mail received by USCIS..
