8老師，萬分感謝，我有幾個非常棘手的問題：
1. 12-13-2013年我file了EB1a，因為我老婆H1過期了（我一直持有H1b並且一直申請過EAD)，所她一直用EAD並且沒有任何有效的Visa。9-2-2014年，EB1a被拒了。我選擇了appeal。悲劇的是當時沒有讓老婆回國簽H4 backup。昨天接到AAO的通知，appeal被拒。
現在才知道，從appeal那天開始就out of status了。除非這個case能夠最終被批準。是這樣嗎？
-Yes, but it seems you mean your EB-1A I-140 was denied, not I-485, and you filed appeal for it, right? If your wife I-485 is sill pending, then her stay is still legal even if the I-140 appeal was denied . So, I suggest that she had better go to China to get the H-4 visa to come back before the I-485 is denied, then file I-485 with your EB-1b I-140 or NIW I-140 if you fail to do the I-485 relink.. If your wife goes to China for application for H-4 vida, she had better also bring the AP with her, thus if she can not get the H-4 visa, and then she can use AP to enter US..
Because your EB1A I-140 is denied, the pending I-485 will also be denied, thus probably your request for I-485 relink will not be accepted (i.e. be dennied). That is why I suggest your wife to get the H-4 visa to come back so that she can have a legal status to file a new I-485. Also, she can apply for EAD either based on H-4 status or based on I-485 if she files a new I-485.

3. 2-1-2015我的EB1b批準了，2-10-2015當我拿到approval notice後就立刻選擇relink，請求USCIS將我的I-485 transfer到我的EB1b 140上來。可惜一直沒有結果。3個月後我發了90days+的followup e-mail並做了inforpass。直到現在還是沒有任何反應。我準備給我們的senator發信請求幫助。我們州有2個senators，請問是2個都發請求，還是選擇1個的好？
4. 如果relink成功的話我老婆的身份是不是就沒問題了？
5. 我的NIW 10月份也可以遞485了。我想再遞一個485，以免老是等在這裏，可以嗎？我老婆可以和我一起遞交485嗎？目前老的485還是open的並且在我MTR期間應該也是一直open的。理論上她目前還不是out of status吧。至於EB1b我就不遞了，就讓它專幹relink這件事。
6. 如果最終結果不好，我老婆是不是隻有等我成為公民之後才有可能再申請綠卡？8老師有什麽好的建議對於我們目前的困境。 再次感謝了。
