我是09年以H1B 被派到美國分公司。 08年美國分公司成立， 申請L1被拒，因資格不夠。
今年初我被PROMOTE GENERAL MANAGER。現在想申請綠卡， 但是谘詢過律師說， 說派遣之前的職位和現在職位要相同，才可以申請EB1C. 是不是沒有機會了呢，還是一定要申請EB2 呢。
I currently live in the United States on my H-1B visa with my families. I was assigned to our US Branch as International Operation Analyst (as specified in the original H-1B petition). My responsibility was international marketing and business development. Early this year, I was appointed General Manager of our Houston Corporation. Currently we have five permanent employees and on sales consultant. Our specialty is trading the products from our affiliates in China and providing supports and services for such products. The company was incorporated in Texas in 2008 and has positive financial results for the past three years. I am wondering whether I am qualified for EB-1 or I have to go through EB-2. By the way I hold a Master Degree.
