前一個雇主交的I-140很早以前已批準,兩年前換到現雇主,I-140和I-485 concurrent filing同時上交,I-485排期已到,8月份將到達pending 180天,現在EAD和AP已到手。最近公司裁掉了一批人,有點人心惶惶。請問我這種情況,如果180天內被裁,會有什麽影響?
-Normally, USCIS will send you RFE for your employment status. So, you need to have a new job or job offer in the same/similar field.  Because you are laid off, not you resign for job change, probably USCIS will not give you trouble even if you do not work for the current employer who sponsored your I-140 within 180 days after I-485 filing.


If USCIS does not send you RFE for employment status, your I-485 pretty safe. But you still need to find a new job as soon as possible,  in case.


EAD可以直接申請別的工作嗎?
-Yes.

需不需要馬上回國?
-No.

有沒有必要請求現雇主等到180天滿後再裁?
-That will be better, but if they insist to lay off you, it does not matter that much (see above), and you just explain it to USCIS if necessary (enclose the layoff letter). The critical thing is to find a new job in the same/similar field as soon as possible.
