本人前天發了以下帖子(見末尾)。現在想接受8老師建議,直接跳過這位律師去把opt給學校hr director看。現有補充和疑問如下:
1. 這位律師的身份我可能沒說清楚,她實際上是這個學校 office of intetrnational students and scholars的,所以該校的F-1 I-20都歸她管。另外,學校新雇教師的H1-b的申請和transfer也是她管。正式title是Assistant Director, Immigration Services, Office of International Students and Scholars
2. 我要是直接把opt拿去給hr,(1) hr 是否有自己單獨的律師核實我的opt的有效性?(2) 還是說,hr最後還是會把我的case 轉給這位律師,讓她做相應的背景調查?要是後者的話,她是否會覺得我在嚴重欺騙她?
3.我要是直接把opt拿去給hr,但最後somehow還是不被承認,是否有很嚴重的後果?比如喪失當前的F-1身份之類的?
4. 萬一opt走不通的話,我是不是隻能等我的485 ead批下來才能工作?這樣的話,在485 ead批下來之前,我是否仍要把自己看成是F-1 opt, 並遵守unemployment 少於90天的規定(opt)?

本人phd剛畢業,在一個學校找到一個教職工作,2012年1月份開始。opt已於11月上旬披下來。同時在11月中旬又遞了485。新學校的律師 不是很nice,之前谘詢485事宜時,她還讓我盡快遞485,說和我的opt應該不衝突,因為這是一個grey area。但我最近把opt給她,
-Why did you show your EAD to the lawyer? You just need to show the OPT EAD to your HR directot and work, and it is irrelevant to the lawyer.
想開始正式的hiring process時,她又一口咬定我的這種情況opt已經無效了,因為我有移民傾向。
我現在很著急,因為485ead一時半會兒還下不來。我還發了網上關於"遞485後opt仍有用"的律師陳述給她,但她根本不理我。請問老師,我該怎麽辦?
-This is a gray area. Some lawyers say I-485 filing will affect existed F1 status, but some say don't affect it. In my opinion, I-485 filing does not affect your approved OPT, but will affect you to extend your F1 status. Here is an old INS Memo and you may print out this INS (prevous USCIS name) document from the following website and highlight the following section and then discuss it with your lawyer:
