根據紐約行政法第63條12款川普被民事起訴和最後定罪

New York Executive Law § 63(12) which authorizes the Attorney General broad powers to investigate and prosecute cases of civil fraud. 63/12 並不是common law concept of fraud and deception.

川粉大聲疾呼不公平沒有受害者，no harm , no foul 等。是的，銀行甚至作證 we are happy to have Trump as our client. 如果銀行是受害者會自己起訴川普under common law fraud and deceit 用不著勞Attorney General 大駕。
川普寃呀！是嗎？

63/12作用防止unjustment enrichment 不當得利。For instance, 如果川普不用欺騙手段，隻能得到100元貸款，by inflating the value of his properties, 才能得到一千元的貸款。銀行沒有受損，川普接時歸還貸款。但川普用了非法手段得到的一千大洋去造灑店，golf courses等，賺得盤滿。The Attorney General 就是利用63/12令川普吐出unjust profits. 在法律上我們稱disgorgement.  至於是否selective prosecution, 另當別論。

所以川普被民事起訴是用足夠法律根據的。
