Insurance Insights UT FLEX Medical: New Rules for Over-the-Counter Expenses Effective January 1, 2011On January 1, 2011, new regulations go into effect as a result of federal Healthcare Reform legislation that will impact your over-the-counter (OTC) product purchases. The new rules state that any OTC item that is considered a drug or medicine will require a prescription from a doctor in order to be reimbursable under your flexible spending account plan.
What items will require a prescription in order for the expense to be eligible for reimbursement under my UT FLEX account?
The following categories of OTC drugs and medicines will require a prescription in order to be considered an eligible expense beginning January 1, 2011.
Acid Controllers
Cough, Cold and Flu medicines
Allergy and Sinus
Digestive Aids
Antibiotic Products
Laxatives
Baby Rash Ointments
Pain Relief Stomach Remedies
Sleep Aids
What OTC items can I continue to buy without needing a prescription?
The following categories of OTC items will continue to be eligible for reimbursement without a prescription.
Band-Aids
First Aid Supplies
Birth Control
Insulin and Diabetic Supplies
Contact Lens Solution
Ostomy Products
 Denture Adhesive
Reading Glasses

Using your PayFlex Debit Card to purchase OTC itemsOn January 1, 2011, you can continue to use your PayFlex Debit Card to purchase OTC eligible items at merchants who have an IRS-approved system in place recognizing expenses that can be purchased with your card. These merchants are required by regulation to remove the OTC drugs and medicines from their inventory listings which are not automatically eligible (those which will require a prescription) from their inventory listings starting January 1, 2011, which will cause denials at the point of sale if the card is used.Filing a claim for OTC items which require a prescription to be eligibleIn order to be reimbursed for an OTC item that is not on the list of IRS approved expenses, keep the following information in mind:You will need to obtain a prescription from your physician for the OTC drug or medicine. Ask your doctor for a prescription for the OTC drug or medicine. Explain that the prescription is required to get reimbursed through your UT FLEX account. Attach your receipt and a copy of the prescription to a completed claim form and submit the claim form and documentation to PayFlex for reimbursement. .
