剛剛查到中國大使館已經發出了不持異議信，為了方便以後的xdjm們，特將豁免流程，

模板和常見問題總結如下：

（一）申請前必看的網站

（二）基本步驟

第一步，向所屬使（領）館教育處（組）領取《留學人員豁免申請表》，將所需資料寄

過去後，大概1－2周就會收到《申請表》。

此步所需模板：《J簽證豁免申請報告》

J-1 豁免申請報告

尊敬的駐美XX總領館：

按照《J-1簽證豁免申請辦法（修訂稿）》的要求，特此提出豁免本人的J-1兩

年回國服務要求的申請。本人於year年mm月獲得某某大學理學博士畢業證書及博士學位

，year年mm月自費赴美進行博士後研究至今。出國前已與某某單位結清所有關係。

來美（來美多長時間，例如兩年）內，我先在XXX Univeristy進行某某研究，

後轉到University of XXX進行某某研究，該研究對於某某項目有非常重要的意義。該

項目受到University of XXX的高度重視，並決定長期資助該計劃至少3年。本人希望在

回國效力之前能夠完成該項目的研究，特此提出J-1豁免申請。

第二步，向美國國務院DOS在線申請豁免編號（Case Number），在線填表前將護照，I-

94, SSN, 2019等必要信息拿到手邊。記住要填入所有來美國以後的2019表的信息，否

則可能無法成功豁免。在線申請成功後，會得到一個J waiver package。這個package

的第一頁有你的case number和check list。按照這個list準備材料。記住DS-3035表上

一定要簽字！這些資料可以等到大使館發出不持異議信後再寄出。

此步所需模板：《Statement of Reason》

This letter is to request for a waiver for the 2-year home residency

requirement based on “No Objection Letter” that will be obtained from my

home country (P. R. China). The reasons I would like to apply for a waiver

are the followings:

I have been in the U.S.A. since XXX, after receiving my Ph.D. degree from

XXXX. I am currently employed as a Postdoctoral Researcher at the XXXXXXX.

I am not being funded by the United States or Chinese government, or any

international organization.

I specialize in the field of XXXX. （Describe your research project.）

XXXX will sponsor me for this additional period before returning to China.

This will enable me to complete my current project as well as accepting

additional training prior to begin my independent academic career in China.

I will apply for the No Objection Letter and my embassy will directly

provide you with the “No Objection Letter” issued for me.

I appreciate your support and assistance for waiving my two-year home

country residence requirement.

第三步，填寫《申請表》及國內審批。申請表很容易填寫。國內審批部分因人而異，一

般在畢業後半年內出國的就不需要審批了，附上畢業證複印件就行了。如果出國前有單

位的，就必須有原單位出具的《離職證明》。

第四步，將所需資料寄給駐美使（領）館教育處（組），等待審批

豁免編號通知單就是J waiver package的最後一頁，Third Party Barcode Page

此步所需模板：《J簽證豁免申請報告》（同前），你老板所出具的support letter

at University of XXX for this additional period before returning to China.

（三）常見問題FAQs

1. 問：美方機構出具的正式聘書是什麽？需要重新寫嗎？

答：正式聘書就是你現在的offer letter，有效期必須還有半年以上。

bly補充：這個正式聘書可以是offer letter，也可以是你找老板寫的supporting

letter.你當時所拿的聘書不見得還有半年以上有效期，也許已經過期了。因為很多

offer都是一年一簽的，DS2019也是一年一延期，也有的是給2年或者3年。但是對於一

年一簽的人

來講，他申請豁免時候offer letter可能已經過期了。所以有效期半年以上指的不是

offer letter上的有效期，而是你現在持有的DS2019的有效期。

2. 問：護照全本複印件是什麽意思？所有頁都得複印？

答：全本就是所有頁，包括封麵，一頁都不能少，少了大使館會讓你補的。

bly補充：在LA辦的隻需要有效頁。

3. 問：來美曆年IAP-66（DS2019）表複印件包括配偶和子女的嗎？

答：這個我不是很確定，但是我自己是附上了所有dependant的2019表。

bly補充：隻需要你自己的曆年DS2019複印件，dependent的不需要。你

填DS3035時候，把dependent信息寫上就可以了，同時豁免。

4. 問：美國國務院發放豁免編號通知單是哪一個？

答：豁免編號通知單就是J waiver package的最後一頁，Third Party Barcode

Page。

5. 問：申請表上國內單位怎麽填寫？

答：沒單位就填畢業學校。

6. 問：整個豁免過程需要多久？

答：因人因時因地而異，如果你的rp不是很特別，一般是3－6個月。

7. 問：豁免後還可不可以延期？

答：有很多種說法。我建議，最好先延期後豁免。

bly補充：每個人隻有一次申請豁免的機會。豁免後，你可以繼續延期，但是期滿後

你必須回國服務兩年。因為你延期後又有2-year home residency的限製了。

8. 問：給大使館和DOS寄材料的時間先後順序

答：根據個人喜好，可以給大使館寄材料的同時寄出給DOS的資料，也可以等大使館發

出無異議信後再寄出。

9. Q. What if I have new information that may affect my eligibility for a

waiver recommendation? Can I just send that to the Waiver Review Division

and ask for a reconsideration of my previously denied application?

A. If you have already received a final determination from the Waiver Review

Division that denies your request for a waiver recommendation, you will

need to apply again from the beginning for a waiver recommendation. You can

use this new information to support your reapplication. You will need to

follow all of the procedures for reapplication that you followed for your

first application, including paying the $215 fee.

If your application is still pending with the Waiver Review Division and you

have not yet received a final determination, you should send that

information on to the Waiver Review Division for their consideration with

your file. Please remember to write your waiver case number on any

documentation you send and on the outside of the envelope. Please note the

CORRECT ADDRESS to send the documentation.
